TERMS OF SERVICE
The goal of this website is to provide information to a group of
nationals living or aiming to settle in Turkey regardless of their
periods of settlement.
1. General rules and definitions
Mymerhaba.com ("my merhaba") is a website owned, designed
and managed by Armas Iletisim, Pazarlama, Internet, Egitim ve Servis
A.S Istanbul-Turkey ( “Armas” ). This page states the membership
terms and conditions (the "Terms" or the "Agreement")
for this website. Please read this page carefully. In choosing to
use the “my merhaba” web and email service (the "Service"),
you agree to be bound and abide by all of the terms and conditions
of this Agreement between you and “Armas”. The terms of this Agreement
cover all uses made by you of the Service, both directly through
“my merhaba" and through the Service's affiliate partners ("Affiliate
Partners").
Any references herein to “my merhaba” shall be deemed to refer
to mymerhaba.com and/or Armas, as applicable.
1.2 “my merhaba” is a registered trademark of Armas Iletisim, Pazarlama,
Internet, Egitim, Servis A.S. Istanbul-Turkey or its affiliates.
All rights reserved. These and other “my merhaba” graphics, logos
and service marks and trademark may not be used without prior written
consent of Armas or its affiliates, as the case may be. All other
trademark, product names, company names and logos appearing on "my
merhaba" are the property of their respective owners.
“Armas” may change, add, or remove portions of this Agreement at
any time, but if it does so, it will post such changes on the "Service",
or send them to you via email or postal mail.
1.4 If any of these rules or any future changes are unacceptable
to you, you may cancel your subscription by sending email to: unsubscribe@my
merhaba.com see section 11.1 regarding termination of the Service).
Your continued use of the Service now, or following the posting
of notice of any changes in these operating rules, will indicate
acceptance by you of such rules, changes or modifications.
1.5 “Armas” may change, suspend, or discontinue any aspect of the
“Service” at any time, including the availability of any “Service”
feature, database, or content. “Armas” may also impose limits on
certain features and services or restrict your access to parts or
all of the "Service" without notice or liability.
1.6 Most of the "my merhaba" service is intended for
adults, and you must be eighteen (18) years or older to use the
"Service" except the section prepared especially for kids
and teens.
2. "Service" content and member submissions
2.1 The Content of the "Service" consists of all materials
published in the "Service" (including but not limited
to text, documents, news articles, photographs, images, illustrations,
audio clips, graphics and video clips). The “Service” and its Content
are intended for your personal, non-commercial use only. Neither
“Armas” nor the author of any Content in the “Service” is liable
for any delays, inaccuracies, errors or omissions in the “Service”
or its Content, or for any damages arising there from.
2.2 The “Service” and its Content are protected under Turkish laws.
The Content is owned or controlled by “Armas” or the party, which
created the Content. You are the copyright holder of all Content
created by you and posted on the "Service". You agree
not to modify, publish, transmit, reproduce, create new works from,
distribute, perform, display, or in any way exploit the "Service"
(including software) or any Content not authored by you except as
explicitly provided in Section 2.3 of this Agreement. Some Content
in the "Service" may contain additional copyright notices
or restrictions and you agree to abide by them.
2.3 You may download or copy the Content and other downloadable
items displayed on the "Service" for personal use only,
provided that you maintain all copyright and other notices contained
therein. Copying or storing of any Content for other than personal
use is expressly prohibited without prior written permission from
“Armas”, or the copyright holder identified in the copyright notice
contained in the Content. You may create or add to an Interaction
and forward Interactions to other "my merhaba" members
subject to the rules in Section 3 of this Agreement.
2.4 You agree that any Content created by you and published on
the “Service” may be copied, edited, removed, reused, modified,
published, transmitted and displayed in all media by “Armas”, the
“Service”'s Affiliate Partners and their successors, assigns and
licensees, and you hereby grant to those entities the right to do
so. In addition, you waive any moral rights you may have in with
respect to the Content being altered or attributed in a manner not
agreeable to you.
3. Interactions
3.1 Interactions are those portions of the "my merhaba"
"Service" (including but not limited to question-and-answer
exchanges, discussions, chat and commentary) where members post
Content for public display in the "Service" ("Interactions").
You shall not upload to, or distribute or otherwise publish in any
Interaction any libelous, defamatory, obscene, pornographic, gratuitously
sexual, abusive, harassing or otherwise illegal material.
3.2 a) Be courteous. You agree that you will not threaten or verbally
abuse other members, use defamatory language, or deliberately disrupt
Interactions with repetitive messages, meaningless messages or "Spam."
b) Use respectful language. The "my merhaba" "Service"
is as helpful and reliable as the people in it. Like any community,
it flourishes only when its members feel welcome and safe. You agree
not to use language that abuses or discriminates on the basis of
race, religion, nationality, gender, sexual preference, age, region,
disability, etc. Hate speech of any kind is grounds for immediate
and permanent removal from the "Service".
c) Use appropriate language. Some Interactions may deal with sensitive
topics. While “Armas” encourages open exchanges, even about adult-oriented
issues, members are asked to consider the different ages and sensitivities
of the entire community while participating in the "my merhaba"
"Service".
d) Debate, but don't attack. In a system full of opinions and preferences,
people always disagree. “Armas” encourages active Interactions and
welcomes heated debate in the “my merhaba” “Service”. But personal
attacks are a direct violation of this Agreement and are grounds
for immediate and permanent removal from the "Service".
e) Remember that member participation is what makes the "my
merhaba" "Service" valuable. If you post information
other members consider unsuitable or disrespectful, people will
leave your Interactions and you will lose the opportunity to connect
with other members and share your knowledge.
3.3 The Interactions shall be used only in a non-commercial manner
except for the areas of "Classified Ads" and "Product
Show Case". You shall not, without the express approval of
"Armas”, distribute or otherwise publish in the “Service” any
Content which contains (i) offers to buy or sell goods or services;
(ii) advertising; or (iii) commercial solicitations of any kind.
Examples of prohibited solicitations include efforts to obtain funds
or services from members and attempts to recruit members to participate
in research studies, polls, surveys or lawsuits.
3.4 THIS "SERVICE" DOES NOT PROVIDE MEDICAL, LEGAL OR
FINANCIAL ADVICE. All the Content of the "Service", including
all Interactions, are for informational purposes only. The "Service"
is not intended to be a substitute for professional medical, legal
or financial advice. You should never disregard professional advice
because of something you've received from or read in the "my
merhaba" "Service".
3.5 All "my merhaba" members are free to offer recommendations
about products and services, including their own or their employer's.
However, if you are discussing or recommending a product or service
with which you have a professional affiliation, you must state that
affiliation. "Armas” reserves the right, at its sole discretion,
to remove messages that it deems to be advertisements by nature
of their content, format, tone or use in the “Service”. Members
disregarding this policy may have parts or all of their access to
the “Service” restricted without notice.
3.6 You are solely responsible for the Content you post in the
“Service”. However, while “Armas” does not and cannot review every
Interaction in the “Service” and is not responsible for the Content
of these Interactions, “Armas” reserves the right to delete, remove,
or edit Interactions that it, in its sole discretion, deems abusive,
defamatory, obscene, in violation of copyright or trademark laws,
or otherwise unacceptable.
4. Commercial Content
Modules and areas such as Classified Adds and Product Show Case
are designed to be used for commercial announcement.
5. Access and availability of service and links
5.1 The "Service" contains links to other related World
Wide Web Internet sites, resources, and sponsors of the "Service".
"Armas” is not responsible for the availability of these outside
resources, or their contents, and you should direct any concerns
regarding any external link to the site administrator or Webmaster
of such site.
6. Representations and warranties
6.1 You represent, warrant, and covenant that no materials of any
kind submitted through your account will (i) violate, plagiarize,
or infringe upon the rights of any third party, including copyright,
trademark, privacy or other personal or proprietary rights; or (ii)
contain libelous or otherwise unlawful material. You hereby indemnify,
defend, and hold harmless "Armas”, the “Service”'s Affiliate
Partners, and all of their respective officers, directors, employees,
and affiliated companies (collectively, the "Indemnified Parties")
from and against any and all liability and costs, including, without
limitation, reasonable attorneys' fees, incurred by the Indemnified
Parties in connection with any claim arising out of any breach by
you or any user of your account of this Agreement or the foregoing
representations, warranties, and covenants. You shall cooperate
as fully as reasonably required in the defense of any such claim.
"Armas” reserves the right, at its own expense, to assume the
exclusive defense and control of any matter subject to indemnification
by you.
6.2 "my merhaba" Website and materials contained therein
are provided on an "AS IS" basis without any warranties
of any kind, either express or implied. Neither “Armas” nor its
affiliates nor any of their officers, directors or employees agents,
third party content providers, merchants, sponsors, licensors or
the like represent or endorse the accuracy or reliability or currency
of any advice, opinion, statement, or other information displayed,
uploaded, or distributed through the "Service" by any
User, information provider or any other person or entity. You acknowledge
that any reliance upon any such opinion, advice, statement, memorandum,
or information shall be at your sole risk.
6.3 Neither does Armas warrant that the Website will operate without
error or that the Website and its server are free of computer viruses
or other harmful code. Armas is not responsible for any costs associated
with servicing or replacing your equipment or data due to your use
of this Website. "my merhaba" contains materials provided
by third parties, and will likewise not be held responsible for
any such third party material.
7. Registration and security
7.1 As part of the registration process, you must provide an email
address and select or be provided with a password. You may also
give us certain registration information, all of which must be accurate
and updated.
(a) You may not (i) select or use the email address, member name,
or name of another person with the intent to impersonate that person;
(ii) use an email address or member name in which another person
has rights without such person's authorization; or (iii) use a member
name or name that “Armas”, in its sole discretion, deems offensive.
Failure to comply with the foregoing shall constitute a breach of
this Agreement, which may result in immediate termination of your
account.
(b) You shall be responsible for maintaining the confidentiality
of your password, which you will not have to reveal to any representative
or agent of "Armas”.
7.2 You shall notify support@mymerhaba.com of any known or suspected
unauthorized use(s) of your account, or any known or suspected breach
of security, including loss, theft, or unauthorized disclosure of
your password or credit card information.
7.3 You are responsible for all usage or activity on your "my
merhaba" account, including use of the account by any third
party authorized by you to use your email address, member name,
display name, and password. Any fraudulent, abusive, or otherwise
illegal activity may be grounds for termination of your account,
at "Armas”'s sole discretion, and “Armas” may refer you to
appropriate law enforcement agencies.
8. Fees and payments
8.1 “Armas” reserves the right at any time to charge fees for access
to portions of the “Service” or the “Service” as a whole. However,
in no event will you be charged for access to the “Service” unless
we obtain your prior agreement to pay such charges. Thus, if at
any time “Armas” requires a fee for portions of the “Service” that
are now free, “Armas” will give you advance notice of such fees
and the opportunity to cancel your account before such charges are
imposed.
9. Communications between "my merhaba" and members
9.1 Unless you indicate on your registration form that you do not
want to receive such information, "my merhaba" its owners
and assigns, reserve the right to allow certain third-party vendors
to provide you with information about products and services.
9.2 "my merhaba" reserves the right to send email to
you for the purpose of updating you on Interactions in which you
are participating, informing you of changes or additions to the
"Service", or requesting your feedback about the "Service".
9.3 "my merhaba" reserves the right to disclose information
about your usage and demographics to advertisers and other partners,
provided that it will not reveal your personal identity in connection
with the disclosure of such information. For more information please
read the "Service"'s Privacy Statement.
10. Software licences
10.1 You shall have no rights to the proprietary software and related
documentation, or any enhancements or modifications thereto, provided
to you in order to access or use the "Service", including
but not limited to the "Service"'s filtering and routing
software ("Access Software"). You may not sublicense,
assign, or transfer any licenses granted by "Armas”, and any
attempt at such sublicense, assignment or transfer shall be null
and void. You may make one copy of any downloadable software for
archival purposes only. You may not otherwise copy, distribute,
modify, reverse engineer, or create derivative works from Access
Software.
11. Termination
11.1 You may terminate your account at any time by sending email
to unsubscribe@mymerhaba.com. Upon termination, you will receive
a confirmation via email that the request was received, and your
access will be suspended as soon as possible.
11.2 "Armas” may, in its sole discretion, terminate or suspend
your access to all or part of the “Service” for any reason, including,
without limitation, breach or assignment of this Agreement.
12. Miscellaneous
12.1 This Agreement has been made in and shall be construed and
enforced in accordance with Turkish Law. Any action to enforce this
agreement shall be brought in courts located in Istanbul.
12.2 In the event that any statement in this Member Agreement conflicts
with a commitment made by “Armas” in the "Service"'s Privacy
Statement, the Privacy Statement will prevail.
12.3 Official correspondence must be sent via postal mail to: Armas
Iletisim, Pazarlama, Internet, Egitim ve Servis A.S Istiklal Caddesi,
No.373/5 Beyoglu,80050 Istanbul Turkey
12.4 You agree to report any copyright violations of the Member
Agreement to “Armas” as soon as you become aware of them. In the
event that you have a claim of copyright infringement with respect
to material that is contained in the “Service”, please notify:

Armas may, in appropriate circumstances and at its sole discretion,
remove or disable access to material on the Website that infringes
on the rights of others. If you believe that your work has been
used on the Website in a manner that constitutes copyright infringement,
please provide Armas with a written notice - by postal mail, e-mail,
or FAX - that includes the following information:
- The signature (electronic or physical) of a person authorized
to act on behalf of the owner of the exclusive right that is allegedly
infringed
- Identification of the copyrighted work claimed to have been infringed
- A description of where the material in question is located on
the Website
- Your mailing address, telephone number, and email address
The copyright owner, its agent, or the law does not authorize a
statement by you that you believe in good faith that the disputed
use.
A statement by you, under penalty of perjury, that the information
in your notice is accurate and that you are the copyright owner
or authorized to act on the copyright owner's behalf. For purposes
